Terms of Service

1. Purpose

These Terms of Service ("Terms") govern the use of the HairMaxxing mobile application ("App") and the associated website hairmaxxing.com. By downloading, installing, or using the App, the user unconditionally accepts these Terms.

2. Publisher

3. Service description

HairMaxxing provides an AI-assisted haircut visualization service. The user submits photos of their face and receives automatically generated photorealistic haircut suggestions.

4. User account

An account is required to access certain features. The user agrees to provide accurate information and to protect the confidentiality of their credentials.

5. Subscription and payment

Full access to the App ("Premium") requires an auto-renewable subscription, billed through the App Store (Apple) or Google Play Store. Two main plans are offered:

  • Premium Weekly — €2.99 per week.
  • Premium Yearly — €39.99 per year, with a 3-day free trial.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period, directly in the relevant store account settings.

5 bis. Right of withdrawal (EU)

Premium subscriptions grant immediate access to a digital service (AI-generated visualizations available on demand). Under Article 16(m) of Directive 2011/83/EU on consumer rights, you expressly waive your 14-day right of withdrawal as soon as access to Premium features begins, and acknowledge that you will lose this right accordingly.

You can cancel auto-renewal at any time from your App Store or Google Play account settings: access remains active until the end of the current billing period, with no pro rata refund.

6. Win-back offer

After cancelling a yearly subscription, HairMaxxing may offer a one-time win-back plan at €19.99 per year (-50%). This offer is limited to one use per account, cannot be combined with other promotions, and is only accessible through the dedicated link sent after cancellation: it does not appear in the standard pricing grid.

7. Referral program

The user may invite others to join the App via a personal referral code. For every 3 referred friends (account created and validated), the user receives 1 free week of Premium.

  • Rewards can be combined within the limits defined in the App.
  • No cash equivalent, no transfer to another account.
  • HairMaxxing reserves the right to revoke rewards in case of fraudulent use (fake accounts, paid incentives, etc.).

8. Use of photos

Photos submitted by the user are used only to generate the requested visualizations. They are neither resold nor used for advertising. See the Privacy Policy for details.

9. Intellectual property

The App, its editorial content, trademarks, and generated visualizations are the property of HairMaxxing or its partners. Any unauthorized reproduction, distribution, or commercial exploitation is prohibited.

10. Liability

AI-generated visualizations are aesthetic suggestions and do not constitute professional advice. HairMaxxing cannot be held liable for decisions made by the user based on the results provided.

11. Termination

The user may delete their account at any time from within the App. This action permanently deletes all associated data, in compliance with GDPR.

12. Governing law

These Terms are governed by French law. Any dispute will be brought before the competent courts in the jurisdiction of the publisher's registered office.
